Objective Ethical standards state research participation must be voluntary and free of coercion and undue influence, but what if a third party appears to engage in research-relevant coercion, without the researchers’ knowledge? This case study describes this type of situation and its resolution. Methods We are engaged in a randomized clinical trial evaluating pedestrian safety with 7- and 8- years old. Depending on children's rate of learning, families receive up to $1275 for their time. We recently learned a third-party “talent (...) agency,” a firm placing children in modeling and acting jobs, was referring families to our research with the expectation that families would share 20% of study reimbursements. Results We sensed clear impropriety, but identified no ethical violations on our part as researchers. Once paid a study reimbursement, participants can spend funds how they wish. We were concerned, however, that the third-party was exploitatively coercing families to participate. Conclusions We pursued four avenues to resolve the issue. First, we documented the situation to our university Institutional Review Board. Second, we contacted the talent agency and requested they stop referring families to our research. They agreed. Third, we retained children engaged in our study who were referred from the talent agency; removing them partway through the clinical trial could impact study results. In doing so, we explained that we were unaware of the talent agency referral and that they were not obligated by us to offer a portion of the study reimbursement to the talent agency. Acculturation is the process through which an individual's cultural behaviors and values change via contact with a majority or host culture. Although some individuals accomplish acculturation smoothly, most experience psychological stress during the acculturation process. When psychologists encounter individuals struggling to acculturate, they are mandated by ethical guidelines and principles to help through several steps: (a) recognize their own biases, beliefs, and attitudes that may influence their work with the acculturating individual; (b) develop competence to work with individuals whose cultural (...) beliefs and practices differ from their own; (c) counsel the acculturating individual using scientifically supported techniques; and (d) intervene without discrimination or disrespect. David Shaw has a Master of Arts degree in Philosophy from the Aquinas Institute. This three-year in-depth study of Aristotle was illuminated with commentaries by Thomas Aquinas. Many persons believe that God has created everything that is. I do not disagree with them but I am not satisfied with this generality. There is no guidance in this belief. We have endured 300 years since the revolutionaries of modern science began their dismemberment of the Greek cosmos that had endured for (...) 2,000 years. We now have no theory of creation. The Hebrew cosmos and the Greek cosmos made up the traditional theories of creation for the western world. Since many have forgotten this history, I summarize it before venturing into my proposal for a new theory of creation. Our universe and the ancient universe are vastly different. The ancient universe was static. It was thought to have no history. Our universe is dynamic. It has a history. Harold Morowitz has identified 28 emergences of new complexity in our universe [1]. I propose a new theory of creation. I give four arguments for community as the next emergence based on the statements of four great thinkers: Plato, Thomas Jefferson, Martin Luther King, and Michael Sandel. These thinkers do not propose community as the next emergence, they do identify community as a central process in human affairs. A description of my experience with community-building projects is included. Given its clinical significance, horror should occupy a prominent place within emotion theory. However, conceptualizations of horror within psychological science are relatively underdeveloped and conceptually confused. Through conceptual analysis of the disparate literature on the emotion, we seek to establish horror as a qualitatively distinct mode of engagement with the world and to remedy its over-intellectualization, as evident in many prior accounts. Given its etymology, we first address horror's characteristic immobilization—at the level of stereotypical facial configuration and action readiness—before analyzing (...) horror's formal object and appraisal structure. In the process, we critique schema accounts of the emotion and argue for conceptualizing horror pre-reflectively by grounding it in appraised violations of the practical dynamics of social engagement. Critics of Rawls's A Theory of Justice frequently envision his original position as containing a human consciousness. Thus, the re- strictions Rawls introduces for this ‘individual’—the lack of particular circumstantial and personal information—is considered a potential problem. The very ways in which Rawls circumscribes the knowledge available in this position is thought to compromise the personhood of the individual there, and hence as well the conclusions reached (that is, Rawls’s two principles). This paper will argue that, on the contrary, the (...) lack of full personhood is a critical part of Rawls’s modeling strategy, and that Rawls borrowed this particular sense of modeling from eco- nomics. It is well known that Rawls worked to verse himself in economic theory, and it is difficult to overlook its use in Theory. It will be argued that it is through parallels with economic reasoning that Rawls’s original position model can be most fruitfully understood. (shrink)

Growing ties to private industry have prompted many to question the impartiality of academic bioethicists who receive financial support from for-profit corporations in exchange for ethics-related services and research. To the extent that corporate sponsors may view bioethics as little more than a way to strengthen public relations or avoid potential controversy, close ties to industry may pose serious threats to professional independence. New sources of support from private industry may also divert bioethicists from pursuing topics of greater social importance, (...) such as the needs of medically underserved communities. To inform ongoing debates about the financing of bioethics and its transparency to those concerned about potential sources of bias, we examined funding disclosures appearing in original research reports in major bioethics journals. Reviewing research published over a 15-year period, we found little evidence that for-profit corporations are influencing bioethics research directly. Instead, we found evidence that a great number of organizations, both public and private, support bioethics research. These findings suggest that worries about the cooption of bioethics research by a few interested stakeholders are greatly overstated and undersupported by available data. (shrink)

Against the backdrop of ancient, mediaeval and modern Catholic teaching prohibiting killing (the rule against killing), the question of assisted suicide and euthanasia is examined. In the past the Church has modified its initial repugnance for killing by developing specific guidelines for permitting killing under strict conditions. This took place with respect to capital punishment and a just war, for example. One wonders why in the least objectionable instance, when a person is already dying, suffering, and repeatedly requesting assistance in (...) dying, there is still such widespread condemnation of assisted suicide and euthanasia. In a Gedankexperiment, I suggest that certain stories of martyrdom in the history of the Christian Church shed some light on the role of taking one’s life, or putting one’s life in danger out of love. I further suggest that requesting assisted suicide and/or euthanasia from the motive of love of one’s family or care givers might possibly qualify as one instance of justifiable euthanasia, although I acknowledge that the Church will not be making changes in its stance any time soon. Diagnosis is widely regarded to be governed by logical rules, but constructing a rational treatment plan has received less philosophical attention. I examine such treatment plans under three senses of the term "rational": consensual, scientific, and ethical. My thesis is that treatment plans, even those based on medical indications alone, are inherently consensual and are governed by a logic of proportionality. There are several branches of ethics. Clinical ethics, the one closest to medical decisionmaking, can be seen as a branch of medicine itself. In this view, clinical ethics is a unitary hermeneutics. Its rule is a guideline for unifying other theories of ethics in conjunction with the clinical context. Put another way, clinical ethics interprets the clinical situation in light of a balance of other values that, while guiding the decisionmaking process, also contributes to the very weighting of those values. (...) The case itself originates ideas, not only about which value ought to predominate in its resolution, but also provides the origin of clinical rules that can be used in other cases. In a morally fragmented society there is no good reason for ethics committees to assume any particular point of view, yet failure to do so compromises their ability to function in either a case‐review or an educational capacity. A casuist methodology might enable committees to fulfill both roles.

During 1992, academic bioethicists celebrated the 30th anniversary of bioethics. Some like to date the origin of modern secular bioethics to the advent of transplant technology that began with kidney transplantation in the early 1960s in the Seattle, Washington, area. This is certainly a good candidate for a starting point. Another might be the work of Joseph Fletcher in the New York area with the Euthanasia Society of America and with clergy training. Still another candidate for the origins of secular (...) bioethics would be the trial of physicians at the University of Virginia for transplanting a kidney at which the same Joseph Fletcher testified. At that trial, the alteration occurred in American law from a definition of death that focused on the cessation of heartbeat to one that focused on the cessation of brain function. (shrink)

The organism is one of the fundamental concepts of biology and has been at the center of many discussions about biological individuality, yet what exactly it is can be confusing. The definition that we find generally useful is that an organism is a unit in which all the subunits have evolved to be highly cooperative, with very little conflict. We focus on how often organisms evolve from two or more formerly independent organisms. Two canonical transitions of this type—replicators clustered in (...) cells and endosymbiotic organelles within host cells—demonstrate the reality of this kind of evolutionary transition and suggest conditions that can favor it. These conditions include co-transmission of the partners across generations and rules that strongly regulate and limit conflict, such as a fair meiosis. Recently, much attention has been given to associations of animals with microbes involved in their nutrition. These range from tight endosymbiotic associations like those between aphids and Buchnera bacteria, to the complex communities in animal intestines. Here, starting with a reflection about identity through time, we consider the distinctions between these kinds of animal–bacteria interactions and describe the criteria by which a few can be considered jointly organismal but most cannot. This overview of the "sister arts" of the nineteenth century by younger scholars in art history, literature, and American studies presents a startling array of perspectives on the fundamental role played by images in culture and society. Drawing on the latest thinking about vision and visuality as well as on recent developments in literary theory and cultural studies, the contributors situate paintings, sculpture, monument art, and literary images within a variety of cultural contexts. The volume offers fresh and sometimes extended (...) discussions of single works as well as reevaluations of artistic and literary conventions and analyses of the economic, social, and technological forces that gave them shape and were influenced by them in turn. In recent years, Bayesian probability theory has emerged not only as a powerful tool for building computational theories of vision, but also as a general paradigm for studying human visual perception. Judicial reasoning in termination of treatment decisions has neglected valid state interests in the preservation of life and the ethical integrity of medicine. Courts must balance these interests against individual liberty, rather than assuming that patient autonomy is absolute.

In a 1990 lecture Alasdair MacIntyre identified a number of difficulties in dialogue between philosophers of the Aristotelian and Thomist schools and those of certain modern schools. An examination of various interpretations of Aquinas reveals not only difficulties for inter-school dialogue but for intra-school dialogue as well. Even on foundational topics such as the notion of being, the proper method by which to study being, and the notion of substance, there are divergent opinions about what Aquinas held. This essay argues (...) that certain concepts from Gadamer can be helpful on these disputes. In particular, Gadamer’s ideas that to be is to be manifested, that a perspective-free metaphysics is impossible, and that the relationship between text and performance can serve as a model for understanding the relationship between substance and accident may help to resolve certain internecine disputes within the Aristotelian and Thomist schools as well as to foster philosophical conversation between these approaches and some contemporary schools of thought. Can it be already 30 years since the first days of modern, secular bioethics? As those of us in the field for almost all these years arrive near the end of our careers, we find that time has truly flown and the challenges have not diminished one bit. If anything, they are even greater than in the early years. Along the way it was tempting to think that the broad consensus reached on research ethics, on the four principles, on the (...) need for consent in clinical ethics, and then on rights in reproduction and dying, would paint the picture rather well. Only fill-in would be needed by the apprentices coming afterward. Yet time and again new biological and medical discoveries continued to challenge that painting. A new canvas had to be hung. Among the major newer developments were the challenges of healthcare reform, genetics, antifoundationalism, the certification of ethics consultants, and now, the internationalization of bioethics, its relationship to the environment and world politics, and biotechnology. The conventional approach to law and religion assumes that these are competing domains, which raises questions about the freedom of, and from, religion; alternate commitments of religion and human rights; and respective jurisdictions of civil and religious courts. This volume moves beyond this competitive paradigm to consider law and religion as overlapping and interrelated frameworks that structure the social order, arguing that law and religion share similar properties and have a symbiotic relationship. Moreover, many legal systems exhibit religious characteristics, informing (...) their notions of authority, precedent, rituals and canonical texts, and most religions invoke legal concepts or terminology.
